Constitution & Bylaws of Local 083

Constitution:

Article 1 – Name

The name of this organization shall be the Oregon State University (OSU) Local 083, hereinafter referred to as the “Local,” of the Oregon Public Employees Union, hereinafter referred to as the “Union.”  

Article 2 – Purpose 

The OSU Local 083 is a labor organization subdivision of the Union and is established for the purpose of representation of its members as set forth in and in accordance with Article II – Purpose, of this Union’s Constitution. 

Article 3 – Membership

All members of the OSU Local 083 bargaining unit, represented by the Union as set forth in Article IV – Membership of the Union’s Constitution shall be members of the OSU Local 083 in accordance with Article V – Locals of the Union’s Constitution. 

Article 4 – Officers

Section 1 – The officers of the Local shall be the President, the Vice President, the Secretary, and the Treasurer.
Section 2 – Officers shall be elected by vote of the membership of the Local either by direct mail ballot or by duly publicized Local meetings attended by at least 25% of the voting membership. In the event of a direct mail ballot, ballots shall be delivered to the membership of the Local in such a manner that the membership may cast their ballots not later than March 31 of even-numbered years. Nominations shall be made by direct mail and/or at a meeting of the Local to be held in February of even-numbered years.
Section 3 – Each officer shall be elected for a two-year term to begin at the first meeting of the Local after voting has been completed. 
Section 4 – The officers and the Local’s Chief Steward shall constitute the Executive Committee, empowered to transact all Local business between meetings of the Local. 

Article 5 – Meetings

Section 1 – The Local shall meet at least six times per year and at least one of these meetings shall be prior to the Union’s bi-annual General Council to comply with Article XIII – General Council of the Union’s ByLaws.
Section 2 – Quorum – All members attending a duly publicized meeting of the Local shall constitute a quorum, whereby and hereinafter “duly publicized” shall mean with at least seven (7) days notice.

Bylaws: 

Article 1 – Duties of the Local

Section 1 – The primary duties of the Local shall be to administer collective bargaining agreements for the betterment of the members of the Local, to develop a system of communication for bargaining information, to ratify the collective bargaining agreement, to elect officers and stewards from within, and to foster and protect the general goals of the Union. 
Section 2 – Subject to that District’s Constitution and ByLaws, the Local shall appoint or elect representatives to attend District meetings in each District where the Local has members. 

Article 2 – Duties of Officers

Section 1 – President – The President shall preside over all meetings of the Local and the Executive Committee, and serve as the Higher Ed Council Delegate or appoint another elected officer to the Higher Ed Council, and appoint members to special committees. The President shall serve as a representative to District meetings where he/she resides or is employed. The President may also choose to appoint or hold an election for that representative position. The President shall serve as a delegate to the Union’s bi-annual General Council.
Section 2 – Vice President – The Vice President shall be responsible for the Local’s communications system. The Vice President shall, in the absence of or upon request of the President, perform the duties of the President. The Vice President shall replace the President for the unexpired term in the event of the death, incapacity, resignation or removal of the President. The Vice President shall report to the President on matters concerning communication and educational activities of the Local. The Vice President shall serve as a delegate to the Union’s bi-annual General Council.
Section 3 – Secretary – The Secretary shall record minutes of all meetings. The Secretary will handle all Local correspondence and maintain a file of all Local records. The Secretary shall serve as a delegate to the Union’s bi-annual General Council. 
Section 4 – Treasurer – The Treasurer shall maintain the financial records of the Local and shall be responsible for all request for disbursement of funds on behalf of the Local. All requests for disbursement of funds shall be made to Union headquarters in care of the Treasurer of the Union who shall comply with such requests when they are in compliance with the Constitution and ByLaws of the Union. The Treasurer shall serve as a delegate to the Union’s bi-annual General Council.

Article 3 – Funding

An account for the Local will be maintained by Union headquarters (Central Ledger System). Funds will be disbursed to the Local by headquarters as approved by the Treasurer of the Local. 

Article 4 – General Council Resolutions

Resolutions to the General Council may be submitted by any member of the Local for presentation to the Local Executive Committee. The Executive Committee shall, by majority vote, endorse or not endorse the resolution. If endorsed, the resolution will be submitted to the Resolution Review Committee for further review, and, if accepted, it will be passed on to the General Council of the Union. It is the duty of the Executive Committee of the Local to insure that all resolutions, submitted to the Resolution Review Committee, follow standard form.

Article 5 – Delegates to General Council

In addition to the President, Vice President, Secretary and Treasurer of the Local, the Local’s Chief Steward shall serve as a delegate to the Union’s bi-annual General Council. Additional delegates, as mandated by the Union’s Constitution and ByLaws, shall be elected from the membership of the Local. Nominations for General Council delegates other than the Local’s officers and Chief Steward shall be an agenda item for the February general membership meeting of the Local during even-numbered years. Nominations may also be made by direct mail.

Article 6 – Committees

Necessary committees may be appointed by the President or nominated by the Executive Committee. Standing Committees will be:

  1. Executive Committee
  2. Stewards’ Council
  3. Campus Action Team

Article 7 – Union Steward and Stewards’ Council

Section 1 – The Local’s Union Stewards shall comprise the Local’s Stewards’ Council. The Stewards’ Council shall elect one of its number to serve as the Local’s Chief Steward. The Chief Steward shall be elected for a term of two years at the meeting of the Stewards’ Council immediately following the election of the Local’s officers.

Section 2 – Union Stewards – The Local’s Union Stewards shall:

  1. Handle grievances of members of the bargaining unit as required by the Union;
  2. Act as the primary communication link amongst the Union, the Local, and the membership in the worksites represented by the Union Steward;
  3. Organize and build the Union in those worksites represented by the Union Steward;
  4. Recommend representatives to the Executive Committee for approval for worker groups in those worksites represented by the Union Steward; and,
  5. Report to the Chief Steward.

Section 3 – Stewards’ Council – The Local’s Steward Council shall:

  1. Prepare bargaining proposals for the Local for presentation to the Union’s bargaining team(s);
  2. Elect the number of Union Stewards allowed the Local by the Collective Bargaining Agreement;
  3. Have the authority to remove inactive or incompetent Union Stewards;
  4. Insure communication among the Union, the Local, and the general membership; and,
  5. Periodically review subdivisions of the bargaining unit to insure adequate representation for all bargaining unit members. 

Section 4 – Chief Steward – The Locals’ Chief Steward shall:

  1. Chair all Stewards’ Council meetings and serve as a member of the Local’s Executive Committee;
  2. Maintain a catalog of all grievances filed against Oregon State University or its subdivisions by grievant’s names and the number of the Collective Bargaining Agreement article violated. This catalog shall indicate the grievance’s final disposition and shall include any other pertinent information that may be of help with future grievances or in bargaining;
  3. Consul with Union Stewards and/or staff regarding representation matters;
  4. Serve as a delegate to the Union’s bi-annual General Council; and,
  5. Oversee the Campus Action Team and consult with Bargaining Delegates. 

Article 8 – Bargaining Delegates

Section 1 – Bargaining Delegates attend all scheduled bargaining meetings; elected Bargaining Delegates select one Local Table Representative and one Alternate Table Representative; educate and inform members of bargaining issues at regular intervals; represent Local 083 at bargaining sessions; assist in the creation of a communication system to communicate bargaining issues.

Section 2 – The number of Bargaining Delegates and Alternates will be determined by the yearly average of bargaining unit employees in the year ending the previous January, per Article IX of the Administrative Policies and Procedures.

Section 3 – Bargaining Delegates and Alternates will be elected at the same time Local officers are and with the same procedure and with the same term. Should any Bargaining Delegate position become vacant due to termination of employment, transfer, promotion, failure to perform as a delegate, or any other reason, vacancies will be filled by duly elected Alternates. 

Article 9 – Elections

Section 1 – Nominations for election of Local officers shall be an agenda item for the February general membership meeting of the Local during even-numbered years. Nominations may also be made by direct mail.

Section 2 – Nominations for General Council delegates other than the Local’s officers and Chief Steward shall be an agenda item for the February general membership meeting of the Local during even-numbered years. Nominations may also be made by direct mail.

Section 3 – Nominations for Bargaining Delegates and Alternates shall be an agenda item for the February general membership meeting of the Local during even-numbered years. Nominations may also be made by direct mail.

Section 4 – All other elections shall be held with adequate notice to the voting membership and in accordance with the Union’s Constitution and ByLaws. 

Section 5 – In the event of a vacancy in a Local officer position other than that of President, adequate notice for nominations shall be given to the voting membership and an election held in accordance with Section 3 of this Article. 

Article 10 – Amendments

The ByLaws may be amended by either a direct mail ballot or at a duly publicized Local meeting. The amendment shall be passed by a simple majority of those voting.
